The Exit and Entry Administration Law Is Being Rewritten: What a Foreign National Should Assess Now

Delta Law Expat Services DeskLast verified

Delta Law Expat Services Desk | State Council 2026 Legislative Work Plan(《国务院2026年度立法工作计划》, Guobanfa〔2026〕No. 14), annex item 11, read against the Exit and Entry Administration Law(《中华人民共和国出境入境管理法》)in force from 2013-07-01.

Status as at 2026-09-07. A revision of the Exit and Entry Administration Law appears as item 11 in the annex to the State Council 2026 Legislative Work Plan. No draft has been published, no draft has been submitted for deliberation, and nothing has taken effect. This page does not predict the content of any draft provision, does not offer a timetable, and does not describe the plan as if it were law.
Key points
  • The official record of the revision consists of its listing. The Plan names the drafting bodies and says nothing about content, and the Plan itself carries no commencement date.
  • Your legal status today still rests entirely on the current Law: chapter 4 on stay and residence, article 39 on accommodation registration, article 41, first paragraph on work authorisation, chapter 6 on investigation and repatriation, and chapter 7 on liability.
  • Two administrative regulations have already moved ahead of the Law. State Council Order No. 814 added the K visa with effect from 2025-10-01; State Council Order No. 841 states a general authenticity and lawfulness requirement and takes effect on 2026-09-15.
  • Because a legal status is proved by records rather than asserted, the practical response to a revision window is documentary: keep the permission, the registrations and the succession of residence permits retrievable as one file.
  • Nothing here should be read as advice to accelerate, delay or restructure anything in anticipation of a draft that does not exist.

2. What the Plan actually says

Focusing on strengthening the foreign-related rule-of-law system and capacity and on serving the expansion of high-standard opening up, the revision drafts of the Customs Law and of the Exit and Entry Administration Law are to be submitted to the Standing Committee of the National People's Congress for deliberation.
Unofficial translation; the Chinese text as officially published prevails.

That sentence states an intention to submit, and places the project in a policy grouping. It does not say when submission will happen, what the draft will contain, or whether the project will proceed at all in this cycle. Everything beyond the sentence is speculation, and this page does not engage in it.

Part one: legislative bills to be submitted to the Standing Committee of the National People's Congress for deliberation (14 items). Item 11: revision draft of the Exit and Entry Administration Law (drafted by the Ministry of Public Security and the National Immigration Administration).
Unofficial translation; the Chinese text as officially published prevails.
This is the whole of the official record about the project as at 2026-09-07: a listing, a position in a list of 14, and two named drafting bodies.

3. Which provisions fix your status today

A foreign national's position in China is not a single permission; it is a set of separate statuses, each created and evidenced by a different provision. Whatever a future draft does, those are the provisions against which your present position is assessed, and they are the ones worth knowing precisely.

Where the visa held by a foreign national states that a residence permit is to be obtained after entry, application must be made to the exit and entry administration of the public security organ of a local people's government at or above county level in the place of intended residence, within thirty days of entry. The application requires the passport or other international travel document together with materials relating to the grounds of the application, and fingerprints and other biometric information are retained. A work-type residence permit is valid for a minimum of ninety days and a maximum of five years; a non-work residence permit is valid for a minimum of one hundred and eighty days and a maximum of five years.
Unofficial translation; the Chinese text as officially published prevails.

The two figures at the end are the reason a residence permit is not a stable fact about a person. It expires on its own terms, it is tied to the grounds on which it was granted, and the file that supported it is what makes the next application straightforward. Article 30 is therefore the anchor for the opening item on the assessment list in section 5 below.

Where a foreign national resides or stays in accommodation other than a hotel, registration must be made with the public security organ of the place of residence, by the person concerned or by the person providing the accommodation, within twenty-four hours of moving in.
Unofficial translation; the Chinese text as officially published prevails.

This is the most frequently overlooked duty in the Law, and the one most likely to be discovered late — at a permit renewal, at a change of address, or when a landlord's own records are checked. It generates a record that either exists or does not, which is exactly the kind of thing worth confirming while nothing is at stake.

A foreign national working in China must obtain a work permit and a work-type residence permit as prescribed. No entity or individual may employ a foreign national who has not obtained a work permit and a work-type residence permit.
Unofficial translation; the Chinese text as officially published prevails.

Two authorisations, not one, and the prohibition in the second sentence runs against the employer as well as the individual. Where a role changes, an entity is restructured or a secondment is extended, the question is whether both documents still match what the person is actually doing.

A foreign national in unlawful employment is liable to a fine of RMB 5,000 or more but not exceeding RMB 20,000; where the circumstances are serious, to detention of five days or more but not exceeding fifteen days, together with a fine of RMB 5,000 or more but not exceeding RMB 20,000.
Unofficial translation; the Chinese text as officially published prevails.

Note that the Chinese thresholds are inclusive at both ends: 五千元以上 means RMB 5,000 or more, and 二万元以下 means RMB 20,000 or less. Chapter 6 of the Law, on investigation and repatriation, sits alongside chapter 7 and governs the measures that may be applied while a question is being examined. Together they explain why a documentary gap is worth closing before anyone asks about it.

One further observation about how these provisions fit together. Chapter 4 creates the status, article 39 creates a record of where the holder actually lives, article 41 creates the authorisation to work, and chapter 7 attaches consequences to gaps in any of them. They are not four separate compliance topics; they are four views of the same file. A question raised under one of them is usually answered — or not answered — by the documents generated under the others, which is why assembling them together is more useful than checking each in isolation.

4. Where administrative regulations have already moved

The structural point worth noticing is that changes affecting foreign nationals have recently arrived through administrative regulations rather than through the Law. That pattern is a fact about what has already happened; it is not a basis for inferring what a draft will contain.

Item one: a further item is added to article 6 as item (6): a K visa, issued to young foreign science and technology professionals entering China.
Unofficial translation; the Chinese text as officially published prevails.

That decision took effect on 2025-10-01 and is already in force. A new visa category was created without touching the Law itself, which is the ordinary division of labour between a statute and the regulations made under it.

Article 3, first paragraph: the grounds on which a person applies for exit, entry, stay or residence must be true and lawful. Article 19: these Provisions take effect on 2026-09-15.
Unofficial translation; the Chinese text as officially published prevails.
As at the verification date of 2026-09-07, State Council Order No. 841 has been published but has not yet taken effect; it takes effect on 2026-09-15.

Article 3, first paragraph states a requirement about the grounds of an application, expressed as a general duty rather than as a list of documents. A general duty of that kind is satisfied, in practice, by being able to show that the grounds recorded in each application matched the facts at the time — which again points at records rather than at arguments.

5. What to assess and document now

Points to check
  • The continuity of the permission. Under 《中华人民共和国出境入境管理法》第四十一条第一款 a work permit and a work-type residence permit are two separate authorisations. Confirm that both are current, that both name the entity you actually work for, and that the role described still matches what you do.
  • The succession of residence permits. Article 30 sets minimum and maximum validity periods and requires an application within thirty days of entry where the visa so states. Assemble the whole sequence — each permit, each renewal, each change of grounds — as one retrievable file rather than as loose documents.
  • The registration record. Article 39, second paragraph, places a twenty-four-hour registration duty on the person or on the provider of the accommodation for stays outside hotels. Check that a registration exists for each address you have used, and keep the confirmation.
  • The grounds you gave. 《国务院关于出境入境管理的规定》第三条第一款 requires that the grounds for an application be true and lawful. Keep, alongside each application, the underlying material that supported the grounds stated in it.
  • Anything that has changed since the last application. A change of employer, address, family circumstances or entity structure is the ordinary trigger for a mismatch between records and facts. Note the date of each change; the date is usually what a later question turns on.

A word on what not to do. A listing in an annual legislative plan is not a reason to change a lawful arrangement, to bring forward or postpone an application, or to restructure an entity. No draft exists to plan against, and a change made in anticipation of a rule that has not been written carries its own risk: the arrangement has to be justified under the provisions that are in force today, and those are the ones set out in section 3. The sensible posture in a revision window is to be accurately documented under the current Law, not to be positioned for a text nobody has seen.

It is also worth being clear about who else holds part of the file. An employer holds the work permit application and the employment records; a landlord or host may hold the accommodation registration; a group head office may hold the secondment paperwork. Where a document you would need is held by someone else, the time to obtain a copy is now, while the relationship is intact.

None of this is a response to the revision. It is what a person in a permission-based status should be able to produce on request. The listing of the project is simply a good reason to do it this quarter rather than next year.

Common misconceptions
  • Misconception: the Law has changed. In fact: the Law in force is the one adopted on 2012-06-30 and in force from 2013-07-01; the Plan records an intention to submit a revision draft, and no draft has been published.
  • Misconception: a listing in the annual plan means enactment this year. In fact: the Plan carries no commencement date and states no timetable for any individual project.
  • Misconception: because the Law may change, current obligations can be treated as provisional. In fact: every obligation described in section 3 applies in full today, and chapters 6 and 7 of the Law continue to apply to breaches of them.
  • Misconception: the recent regulations tell you what the draft will say. In fact: State Council Orders No. 814 and No. 841 are instruments in their own right; nothing in either states anything about the content of a future revision, and this page draws no inference from them.
  • Misconception: a residence permit, once issued, settles your status. In fact: article 30 fixes minimum and maximum validity periods, and the permit remains tied to the grounds on which it was granted.
