The eligibility framework

The national baseline comes from the 2006 Opinions on Regulating the Access to and Administration of Foreign Investment in the Real Estate Market (Jian Zhu Fang [2006] No. 171, the “171 Document”): a foreign individual who has worked or studied in China for more than one year may purchase one residential property for own use and own residence — not for letting out as a business, not as a portfolio. Foreign institutions without a China establishment, and individuals not meeting the one-year test, are outside the door. Over the years enforcement has loosened and tightened with the property cycle, and some cities have relaxed aspects of it in recent policy rounds — which is precisely why eligibility should be confirmed against current local practice, not against a forum post.

In Shanghai, the city’s own purchase-restriction regime sits on top: non-local buyers have historically needed a qualifying record of social insurance or individual income tax payment in Shanghai (commonly described as five years; adjusted for certain districts and statuses in recent policy rounds), with married/single status affecting how many units a household may hold. A foreign buyer must clear both layers. Holders of a Chinese permanent residence card are in a materially better position, being treated comparably to Chinese residents for many purposes — subject to current regulations.

4 · Taxes & registration 税费与登记Deed tax on purchase (rate depends on size and holdings), VAT and individual income tax exposure on a later resale depending on holding period and whether it is the seller’s only home — rates are policy-adjusted, subject to current regulations. Ownership passes on registration at the real estate registry, not on payment.

Can I buy through my WFOE or a company instead?
A China-registered company can hold property needed for its actual operations, but using a company as a wrapper to hold residential property you live in creates tax inefficiency (no personal exemptions, corporate taxes on disposal) and does not escape the regulatory intent of the foreign-buyer rules. For a home, buy as an individual if you qualify; for genuine business premises, buying through the company is normal.

I am leaving China — can I keep the apartment? And sell it later from abroad?
Yes. Ownership is not conditioned on continued residence: you can keep, lease out (registering the lease and declaring rental tax) and later sell the property after you have left. A later sale can be handled through a notarised power of attorney without flying back, and sale proceeds can be remitted out through the bank’s review channel with tax completion documents — see the Depart and Money guides.

What does the 70-year land term actually mean for me?
Your building sits on a granted land-use right — 70 years for residential land, counted from the original grant to the developer, not from your purchase. The Civil Code (Art. 359) provides that residential land-use rights renew automatically on expiry; implementing detail on any renewal fee is still evolving. For a purchase decision the practical point is to check how many years remain on the specific parcel.
