Finance & Dispute ResolutionPartner

Acting for banks, trusts, insurance asset managers, leasing and factoring companies on credit, financial-product and security disputes, in litigation and out of it.

YOUR RESPONSIBILITIES

  • Lead contract, security and financial-product disputes referred by financial institutions, from first instance through retrial
  • Issue written opinions on credit documentation, security structures and risk disposal
  • Set team schedules, control drafting quality and own the outcome of your matters
  • Share sector intelligence and precedent documents within the department

WHAT WE EXPECT

  • At least eight years in practice, five of them concentrated in financial work
  • An established practice or a recognised professional reputation
  • Direct working relationships with the business or risk functions of bank or non-bank institutions
  • Comfortable with a firm organised into practice departments and working in teams

Financial NPL & Debt RecoveryPartner

Recovering non-performing debt for banks, asset management companies and debt purchasers, combining litigation, enforcement, asset realisation and restructuring.

YOUR RESPONSIBILITIES

  • Design and execute recovery plans for debt portfolios and single-borrower claims
  • Handle enforcement objections, auction realisation, joinder of judgment debtors and bankruptcy petitions
  • Work with asset management companies, investors, valuers and auction houses
  • Report recovery progress and interim results to clients on an agreed rhythm

WHAT WE EXPECT

  • At least eight years in practice, having led debt recovery or asset disposal projects of real scale
  • An established practice or a recognised professional reputation
  • Fluent in the interaction between enforcement and bankruptcy procedure
  • Able to run a team at the pace that volume caseloads demand

Intellectual PropertyPartner

Securing, enforcing and licensing trade marks, patents, copyright and trade secrets, using both the administrative and the judicial route.

YOUR RESPONSIBILITIES

  • Lead infringement litigation, administrative determination and invalidation proceedings
  • Design trade mark and patent portfolios, licences and assignments for corporate clients
  • Handle disputes at the intersection of trade secrets and non-competition covenants
  • Organise infringement evidence gathering, notarisation and evidence preservation

WHAT WE EXPECT

  • At least eight years in practice, with a full record of IP litigation and advisory work
  • An established practice or a recognised professional reputation
  • Familiar with how the relevant administrative authorities and specialist courts decide cases
  • A patent agent qualification or a science or engineering background is an advantage

Commercial Dispute ResolutionPartner

Litigation and arbitration in corporate, equity, contract and construction matters, including bringing cross-border disputes home for enforcement.

YOUR RESPONSIBILITIES

  • Lead commercial litigation and domestic or international arbitration, setting procedural strategy and marshalling evidence
  • Draft contractual and dispute resolution clauses before a dispute arises
  • Handle jurisdiction, interim measures, evidence and enforcement stages
  • Divide work with overseas counsel on cross-border matters

WHAT WE EXPECT

  • At least eight years in practice, with a record of leading substantial commercial matters
  • An established practice or a recognised professional reputation
  • Familiar with the rules and practice of the main arbitral institutions
  • A working foreign language is an advantage

  • Lead divorce, property division, succession and custody matters
  • Design pre-marital and marital property agreements, wills and succession plans
  • Trace and divide assets involving company equity and holdings inside and outside China
  • Maintain information barriers and confidentiality on sensitive matters

WHAT WE EXPECT

  • At least eight years in practice, with family and succession work as your main practice
  • An established practice or a recognised professional reputation
  • Experience with cross-border assets or family-business shareholdings is an advantage
